La justice en Guin\u00e9e-Bissau est consid\u00e9r\u00e9e comme la pierre angulaire de la paix entre citoyens. Cependant, le mauvais fonctionnement et la mauvaise administration du syst\u00e8me judiciaire, combin\u00e9s \u00e0 des probl\u00e8mes de corruption et d'impunit\u00e9 g\u00e9n\u00e9ralis\u00e9e, ont entrav\u00e9 la gouvernance efficace du secteur de la justice dans le pays. Les pratiques traditionnelles ou informelles de justice sont tr\u00e8s appr\u00e9ci\u00e9es par la population en Guin\u00e9e-Bissau et sont profond\u00e9ment ancr\u00e9es dans les coutumes des diff\u00e9rentes communaut\u00e9s qui comptent sur elles pour la r\u00e9solution de nombreux conflits. Bien que ces pratiques offrent des avantages en termes de co\u00fbts et d'accessibilit\u00e9 physique, des recherches ont montr\u00e9 comment ces m\u00e9canismes de r\u00e9solution des conflits affectent de mani\u00e8re disproportionn\u00e9e les secteurs vuln\u00e9rables de la population.<\/p>\n

Le secteur de la justice en Guin\u00e9e-Bissau est donc tr\u00e8s complexe et caract\u00e9ris\u00e9 par une pluralit\u00e9 de pratiques, o\u00f9 le syst\u00e8me de justice formel coexiste avec des structures informelles et traditionnelles. L'insatisfaction g\u00e9n\u00e9rale \u00e0 l'\u00e9gard du secteur, caus\u00e9e par des facteurs et des acteurs n\u00e9gatifs, tant dans les pratiques formelles qu'informelles, souligne la n\u00e9cessit\u00e9 d'une am\u00e9lioration. Au cours de la derni\u00e8re d\u00e9cennie, le secteur de la justice a fait l'objet de r\u00e9formes, mais le processus s'est heurt\u00e9 \u00e0 des difficult\u00e9s r\u00e9currentes dans sa mise en \u0153uvre. Dans ce contexte, Interpeace et son partenaire local Voz di Paz ont cherch\u00e9 \u00e0 cr\u00e9er de nouveaux m\u00e9canismes et capacit\u00e9s pour une citoyennet\u00e9 active, habilit\u00e9e \u00e0 suivre, de m\u00eame qu\u2019\u00e9valuer et d\u00e9fendre des politiques publiques ad\u00e9quates dans le secteur de la justice. Un point de d\u00e9part essentiel a \u00e9t\u00e9 l'\u00e9tablissement d'un barom\u00e8tre participatif pour fournir des donn\u00e9es cr\u00e9dibles, ind\u00e9pendantes et repr\u00e9sentatives sur la situation dans le pays, afin de contribuer \u00e0 une participation accrue des citoyens \u00e0 la gouvernance locale de la justice.<\/p>\n

The report entitled, \u201cSintidu di justisa\u201d (The Sense of Justice) - Participatory barometer on the perceptions and experiences of the population: How to improve the governance of justice in Guinea-Bissau<\/strong>, presents the results of a research process carried out across the country between September 2018 and February 2020, engaging more than 4,250 people, including 3,400 direct interviews in 180 communities. The report highlights the main elements that make up the different dimensions of the justice sector, to better understand issues as the concept of justice, access to justice, the experience with justice proceedings, the role of citizens and the role of traditional justice mechanisms. Moreover, a gender analysis was also carried out as part of the initiative.<\/p>\n

The overall findings of this initiative aim to provide a strong basis for structural improvements of the justice sector in Guinea Bissau. Participants described the formal justice procedures as neither sufficiently transparent nor egalitarian and identified some of the major obstacles preventing good governance in the justice sector, including corruption, limited access to justice, social and economic inequality, and a lack of trust in the judiciary system. Expressions like \u201cGuinea-Bissau's justice is applied only to the poor\u201d demonstrate the population's perception of the justice system \u2013 55% of the participants think there is a lot of interference by influential people and 47% think influential people have a lot of impunity. While the fact that half of the population (54%) does not feel safe to report or testify, sheds light on real obstacles in justice practices.<\/p>\n

Le barom\u00e8tre ne montre pas seulement les d\u00e9fis et les faiblesses institutionnelles du syst\u00e8me judiciaire bissau-guin\u00e9en, mais il met \u00e9galement en \u00e9vidence les \u00e9l\u00e9ments du secteur judiciaire les plus pertinents pour la population. La grande majorit\u00e9 de la population (91 %) pense que certains conflits sont mieux r\u00e9solus par la justice traditionnelle, qui est consid\u00e9r\u00e9e comme la meilleure forme de r\u00e9solution des conflits par 61 %, en raison de sa capacit\u00e9 de r\u00e9conciliation et de sa connaissance de la r\u00e9alit\u00e9. En cons\u00e9quence, la majorit\u00e9 de la population insiste sur le fait que le syst\u00e8me judiciaire formel doit trouver des moyens de collaborer avec le syst\u00e8me traditionnel dans la r\u00e9solution des conflits. Par cons\u00e9quent, les r\u00e9sultats du barom\u00e8tre n'indiquent pas une dichotomie ou un conflit entre la justice formelle et la justice traditionnelle. Au contraire, ils signalent le besoin urgent d'un travail collaboratif et coordonn\u00e9 entre les deux syst\u00e8mes.<\/p>\n

En ce sens, l'\u00e9tude formule \u00e9galement des recommandations, des solutions, des mesures et des actions essentielles pour r\u00e9aliser les changements n\u00e9cessaires dans le secteur de la justice afin de d\u00e9velopper un syst\u00e8me plus efficace et r\u00e9pondant aux besoins de la population.<\/p>\n
