Quand il y a des conflits, on fait appel aux chasseurs dozos pour les r\u00e9gler, ils sont tr\u00e8s sollicit\u00e9s. Ils viennent sans chercher \u00e0 comprendre (les probl\u00e8mes) et ils ne connaissent m\u00eame pas les proc\u00e9dures de gestion des conflits. Ils commettent beaucoup d'injustices car toutes les d\u00e9nonciations ne sont pas toujours fond\u00e9es \u00bb. <\/em><em>-Jeune habitant de Niono<\/em><\/p>\n<p>L'acc\u00e8s \u00e0 la justice et la l\u00e9gitimit\u00e9 du secteur de la justice au Mali est une pr\u00e9occupation des communaut\u00e9s depuis des d\u00e9cennies. Dans un pays o\u00f9 les m\u00e9canismes de justice formelle ont toujours fonctionn\u00e9 aux c\u00f4t\u00e9s des formes traditionnelles de justice, auxquelles les communaut\u00e9s ont fait davantage confiance, de nouveaux types d'acteurs proposent des alternatives aux m\u00e9canismes de justice formelle et traditionnelle.<\/p>\n<p>L'affaiblissement de l'\u00c9tat, de sa couverture s\u00e9curitaire et de la fourniture des besoins sociaux de base est corr\u00e9l\u00e9 \u00e0 l'\u00e9mergence d'autres acteurs, enclins \u00e0 mener leurs propres formes de justice et \u00e0 d\u00e9fier l'autorit\u00e9 du syst\u00e8me judiciaire formel. Ceux-ci contribuent \u00e0 catalyser un cycle de violence et de vengeance, ainsi qu'une plus grande m\u00e9fiance de la population envers les m\u00e9canismes formels de l'Etat.<\/p>\n<p>Face \u00e0 ces menaces, les Maliens ont besoin d'un soutien et d'un encadrement plus importants de la part du syst\u00e8me judiciaire pour s'assurer que leurs droits sont respect\u00e9s, pour contrer la mont\u00e9e des id\u00e9ologies promues par les groupes arm\u00e9s, ainsi que pour garantir un traitement transparent et \u00e9quitable. L'ampleur de ces d\u00e9fis appelle une r\u00e9ponse holistique qui d\u00e9passe le cadre strictement s\u00e9curitaire pour englober les aspects de gouvernance, de d\u00e9veloppement et de coh\u00e9sion sociale qui sous-tendent le rapport des populations \u00e0 la justice.<\/p>\n<p>C'est dans ce contexte que l'Institut malien de recherche-action pour la paix (IMRAP), avec l'appui de son partenaire Interpeace, a r\u00e9alis\u00e9 un barom\u00e8tre participatif pour mieux comprendre et analyser les perceptions des citoyens maliens sur les d\u00e9fis de l'acc\u00e8s \u00e0 la justice, les causes de l'impunit\u00e9 et les solutions possibles pour y r\u00e9pondre de mani\u00e8re inclusive et durable.<\/p>\n<p><strong>Incompr\u00e9hension, corruption et manque de ressources comme racines de la m\u00e9fiance<\/strong><\/p>\n<p>Le barom\u00e8tre participatif a recueilli les perceptions et les exp\u00e9riences de plus de 2000 personnes dans 6 cercles du centre du Mali : Mopti, Bandiagara, Djenne, San, S\u00e9gou et Niono. Les personnes interrog\u00e9es comprenaient des membres de la communaut\u00e9, des autorit\u00e9s traditionnelles et des acteurs de la justice, qui ont tous \u00e9t\u00e9 repr\u00e9sent\u00e9s et impliqu\u00e9s dans la cr\u00e9ation des indicateurs, l'enqu\u00eate et l'analyse des donn\u00e9es.<\/p>\n<p><iframe loading=\"lazy\" title=\"Lucie Bello, IMRAP Project Coordinator: Participatory barometer in central Mali\" width=\"500\" height=\"281\" src=\"https:\/\/www.youtube.com\/embed\/2sIPmTKoiY0?feature=oembed\" frameborder=\"0\" allow=\"accelerometer; autoplay; clipboard-write; encrypted-media; gyroscope; picture-in-picture; web-share\" referrerpolicy=\"strict-origin-when-cross-origin\" allowfullscreen><\/iframe><\/p>\n<p>Les r\u00e9sultats du barom\u00e8tre ont montr\u00e9 qu'un obstacle majeur \u00e0 l'acc\u00e8s de la population \u00e0 la justice est caus\u00e9 par l'incompr\u00e9hension et la m\u00e9fiance \u00e0 l'\u00e9gard du syst\u00e8me judiciaire. De nombreux participants ne connaissent pas les voies et les services auxquels ils ont acc\u00e8s. Ainsi, quatre personnes sur dix ont d\u00e9clar\u00e9 ne pas savoir o\u00f9 se trouve le tribunal le plus proche dans leur localit\u00e9. En outre, l'utilisation du fran\u00e7ais comme langue principale dans les proc\u00e9dures de justice et les contextes juridiques, alors que pr\u00e8s de la moiti\u00e9 des personnes interrog\u00e9es ne sont pas all\u00e9es \u00e0 l'\u00e9cole ou ne comprennent pas bien la langue, a constitu\u00e9 un obstacle suppl\u00e9mentaire \u00e0 l'acc\u00e8s \u00e0 ces syst\u00e8mes. Le manque de connaissance des r\u00e8gles et des proc\u00e9dures a \u00e9galement conduit \u00e0 une incompr\u00e9hension accrue, \u00e0 la m\u00e9fiance et m\u00eame au rejet des d\u00e9cisions dans les syst\u00e8mes de justice formels.<\/p>\n<p><iframe loading=\"lazy\" title=\"Sa\u00efbou Traore, Metalworker: Participatory barometer in central Mali\" width=\"500\" height=\"281\" src=\"https:\/\/www.youtube.com\/embed\/ZdlO6PfH-pw?feature=oembed\" frameborder=\"0\" allow=\"accelerometer; autoplay; clipboard-write; encrypted-media; gyroscope; picture-in-picture; web-share\" referrerpolicy=\"strict-origin-when-cross-origin\" allowfullscreen><\/iframe><\/p>\n<p>Dans une r\u00e9gion fortement touch\u00e9e par la pauvret\u00e9, les co\u00fbts des proc\u00e9dures judiciaires et les distances g\u00e9ographiques \u00e0 parcourir dissuadent de nombreux citoyens d'engager des actions en justice. Les consultations ont montr\u00e9 que les co\u00fbts li\u00e9s \u00e0 une proc\u00e9dure, \u00e0 l'assistance d'un avocat et d'huissiers, ainsi que les cautions exig\u00e9es (en particulier dans les affaires civiles) rendent la justice financi\u00e8rement inaccessible \u00e0 une grande partie des communaut\u00e9s cibles. Ce constat g\u00e9n\u00e8re de la frustration chez certains participants et alimente la perception d'une justice in\u00e9gale et \u00e0 deux vitesses.<\/p>\n<p>Afin d'aider les justiciables \u00e0 supporter les frais de proc\u00e9dure, l'Etat a adopt\u00e9 en 2001 une loi sur l'aide juridictionnelle pour faciliter l'acc\u00e8s des pauvres \u00e0 la justice. Dans la pratique, cependant, les entretiens ont mis en \u00e9vidence une application limit\u00e9e de ces mesures, en raison du manque de ressources financi\u00e8res et de la difficult\u00e9 \u00e0 recruter des assistants juridiques capables d'apporter l'aide n\u00e9cessaire aux personnes impliqu\u00e9es dans les proc\u00e9dures.<\/p>\n<p><iframe loading=\"lazy\" title=\"M\u2019bah Fofana, Bureau of Legal and Judicial Office: Participatory barometer in central Mali\" width=\"500\" height=\"281\" src=\"https:\/\/www.youtube.com\/embed\/NoeauQ-1IRc?feature=oembed\" frameborder=\"0\" allow=\"accelerometer; autoplay; clipboard-write; encrypted-media; gyroscope; picture-in-picture; web-share\" referrerpolicy=\"strict-origin-when-cross-origin\" allowfullscreen><\/iframe><\/p>\n<p>Par ailleurs, le barom\u00e8tre montre \u00e9galement que les soup\u00e7ons de corruption et d'ing\u00e9rence remettent en cause la l\u00e9gitimit\u00e9 du syst\u00e8me judiciaire formel. Plus de sept personnes interrog\u00e9es sur dix d\u00e9clarent que les riches et les pauvres ne sont pas trait\u00e9s de la m\u00eame mani\u00e8re dans les proc\u00e9dures judiciaires et estiment que les personnes disposant de plus de ressources sont susceptibles d'obtenir des d\u00e9cisions plus favorables.<\/p>\n<p>Les consultations ont \u00e9galement r\u00e9v\u00e9l\u00e9 l'insatisfaction d'une partie de la population face \u00e0 la lenteur et \u00e0 l'inach\u00e8vement des enqu\u00eates judiciaires, qui favorisent l'impunit\u00e9 et d\u00e9couragent les gens de porter plainte. Pr\u00e8s d'une personne sur deux interrog\u00e9e par le barom\u00e8tre d\u00e9clare avoir peu ou pas confiance dans la r\u00e9solution de ses probl\u00e8mes par le syst\u00e8me judiciaire formel.<\/p>\n<p>Plusieurs magistrats ont \u00e9galement reconnu que des suspects \u00e9chappent parfois \u00e0 la justice parce que les proc\u00e9dures ne sont pas men\u00e9es dans les d\u00e9lais pr\u00e9vus par la loi. Ils attribuent ce dysfonctionnement en grande partie au manque de moyens mat\u00e9riels et humains dont disposent les tribunaux et les services d'enqu\u00eate.<\/p>\n<p><iframe loading=\"lazy\" title=\"Mamadou S\u00e9nou, Judge: Participatory barometer in central Mali\" width=\"500\" height=\"281\" src=\"https:\/\/www.youtube.com\/embed\/lxLmz-_p21M?feature=oembed\" frameborder=\"0\" allow=\"accelerometer; autoplay; clipboard-write; encrypted-media; gyroscope; picture-in-picture; web-share\" referrerpolicy=\"strict-origin-when-cross-origin\" allowfullscreen><\/iframe><\/p>\n<p><strong>\u00ab Nouveaux acteurs \u00bb, instabilit\u00e9 et r\u00f4le des femmes et des autorit\u00e9s traditionnelles<\/strong><\/p>\n<p>Pour 60% des Maliens interrog\u00e9s, l'ins\u00e9curit\u00e9 est un facteur important de l'augmentation de l'impunit\u00e9 dans leur localit\u00e9 et trois personnes sur dix la citent comme le principal obstacle \u00e0 l'application de la loi.<\/p>\n<p>Pris pour cible par les groupes arm\u00e9s, de nombreux magistrats et personnels de justice se sont repli\u00e9s \u00e0 Mopti, S\u00e9gou et Bamako, laissant derri\u00e8re eux des tribunaux au fonctionnement lent et des ressources insuffisantes pour r\u00e9pondre aux besoins et aux demandes de justice de la population. Dans une r\u00e9gion o\u00f9 72% des fonctionnaires interrog\u00e9s ont d\u00e9clar\u00e9 craindre d'\u00eatre agress\u00e9s, kidnapp\u00e9s ou tu\u00e9s lors de leurs tourn\u00e9es quotidiennes, l'ins\u00e9curit\u00e9 emp\u00eache \u00e9galement les unit\u00e9s d'investigation de se rendre sur le terrain pour enqu\u00eater sur les crimes.<\/p>\n<p>Le retrait des fonctionnaires et des forces de d\u00e9fense et de s\u00e9curit\u00e9 vis\u00e9s par les violences a contribu\u00e9 ces derni\u00e8res ann\u00e9es \u00e0 l'apparition de \u00ab nouveaux acteurs \u00bb de la s\u00e9curit\u00e9 et du r\u00e8glement des conflits dans le Centre. Face au retrait progressif des services sociaux de base (s\u00e9curit\u00e9, justice, \u00e9ducation, sant\u00e9, etc.) vers les capitales r\u00e9gionales, la population se tourne de plus en plus vers les autorit\u00e9s traditionnelles et les \u00ab nouveaux acteurs \u00bb tels que les chasseurs dozos, les groupes d'autod\u00e9fense arm\u00e9s et les groupes dits radicaux, selon les zones.<\/p>\n<p>Face \u00e0 la mont\u00e9e de l'ins\u00e9curit\u00e9 et au nombre croissant de nouveaux acteurs, la recherche a \u00e9galement montr\u00e9 que les m\u00e9canismes traditionnels de r\u00e8glement des conflits jouent un r\u00f4le cl\u00e9 en compl\u00e9ment des syst\u00e8mes de justice formels. Ceux-ci utilisent les coutumes, le dialogue et les textes religieux pour r\u00e9gler les conflits, apaiser les victimes et trouver des accords entre les diff\u00e9rentes parties. Ils b\u00e9n\u00e9ficient d'une certaine confiance et l\u00e9gitimit\u00e9 aupr\u00e8s de leurs communaut\u00e9s, qui font appel \u00e0 eux pour arbitrer les litiges et g\u00e9rer les conflits familiaux, fonciers et de cohabitation. Sept personnes sur dix disent s'adresser d'abord au chef de village pour d\u00e9poser une plainte ou obtenir des informations.<\/p>\n<p>Les consultations ont r\u00e9v\u00e9l\u00e9 une forte demande de collaboration et de renforcement mutuel entre les tribunaux et les m\u00e9canismes traditionnels pour am\u00e9liorer l'administration de la justice et lutter contre l'impunit\u00e9. Les personnes interrog\u00e9es reconnaissent les efforts existants mais expriment le besoin d'\u00e9tendre et d'institutionnaliser une collaboration franche et structur\u00e9e qui d\u00e9finit les comp\u00e9tences et les limites des deux syst\u00e8mes. Dans la r\u00e9gion, les femmes ont g\u00e9n\u00e9ralement un niveau d'\u00e9ducation, des moyens financiers et une autonomie plus faibles que les hommes en ce qui concerne les d\u00e9penses et les besoins li\u00e9s aux proc\u00e9dures judiciaires. Il existe une forte pression socioculturelle pour normaliser certaines pratiques discriminatoires et violentes \u00e0 l'encontre d\u2019elles et pour les dissuader d'entamer ou de poursuivre des proc\u00e9dures judiciaires.<\/p>\n<p>La peur d'\u00eatre stigmatis\u00e9es et rejet\u00e9es par le conjoint ou la famille, le manque d'information sur les proc\u00e9dures, le manque d'argent, de soutien et de temps pour aller jusqu'au bout de l'action dissuadent donc de nombreuses femmes de recourir aux institutions pour se d\u00e9fendre et faire respecter leurs droits.<\/p>\n<p><strong>Renforcer davantage la confiance dans les syst\u00e8mes judiciaires du Centre du Mali<\/strong><\/p>\n<p>Le processus de cr\u00e9ation et de recherche du barom\u00e8tre participatif, qui a d\u00e9but\u00e9 en 2021, a d\u00e9j\u00e0 permis d'accro\u00eetre la sensibilisation et de favoriser la confiance entre les communaut\u00e9s et les acteurs de la justice dans les 6 cercles.<\/p>\n<p>Cependant, les obstacles mis en \u00e9vidence par le barom\u00e8tre appellent \u00e0 de nouvelles actions afin de renforcer le syst\u00e8me de justice dans la r\u00e9gion. Les r\u00e9sultats de la recherche seront utilis\u00e9s pour informer les interventions futures, l'engagement avec les acteurs de la justice formelle, ainsi que les autorit\u00e9s traditionnelles et les d\u00e9cideurs politiques dans la r\u00e9gion.<\/p>\n<p>\u00ab Le barom\u00e8tre, \u00e0 travers une \u00e9valuation de la perception de la population des r\u00e9gions de la ceinture moyenne sur les questions de justice, vise \u00e0 \u00e9tablir une meilleure compr\u00e9hension autour des d\u00e9fis, des r\u00e9alit\u00e9s et des opportunit\u00e9s pour un syst\u00e8me et un processus judiciaire am\u00e9lior\u00e9 \u00bb, a d\u00e9clar\u00e9 Kadiatou Keita, repr\u00e9sentante d'Interpeace au Mali. \u00ab Les recommandations issues de ce processus permettraient d'accro\u00eetre la compr\u00e9hension des syst\u00e8mes judiciaires par la population, et de renforcer davantage les cadres de dialogue entre la population, les autorit\u00e9s traditionnelles et les acteurs judiciaires pour finalement combattre l'impunit\u00e9 et restaurer la confiance entre les diff\u00e9rents acteurs.
